Any disputes arising with respect to this Agreement shall be adjudicated by a sole arbitrator to be appointed by Sri Sakthi. The written decision of the arbitrator shall be final and binding on the parties. The arbitration proceeding shall be carried on and heard in Chennai, India using the English language and pursuant to the rules of the Indian Arbitration and Conciliation Act, 1996 or any enactment of statute that may have amended or accordingly replaced the same. The arbitrator shall decide ex aequo et bono or as amiable compositeur. It is agreed that the Terms of Service is the complete and exclusive statement of the mutual understanding of the parties and supersedes and cancels all previous written and oral agreements, communications and other understandings relating to the subject matter of the Terms of Service and that all modifications, except as otherwise provided herein, must be in a writing signed by both parties.
